Abstract

La presente tesis ofrece un análisis jurídico de la contratación pública irregular en el sector público español, con especial atención al ámbito local. Se examinan prácticas contrarias a los principios de publicidad, concurrencia y legalidad, como los encargos verbales, las prórrogas contractuales sin cobertura legal o la falta de planificación. Asimismo, se abordan los distintos mecanismos previstos en el ordenamiento jurídico para la regularización de estas situaciones: revisión de oficio, reconocimiento extrajudicial de crédito, responsabilidad patrimonial y contractual, principio de enriquecimiento injusto, omisión de la función fiscalizadora y la figura del contrato inexistente. La investigación constata el uso generalizado y, en muchos casos, abusivo de estos instrumentos, que han dejado de ser excepcionales para convertirse en mecanismos de uso común. Esta práctica compromete la seguridad jurídica y dificulta la exigencia de responsabilidades a los gestores públicos. La tesis propone reformas de lege ferenda, como la creación de un procedimiento único de regularización, la simplificación de la contratación menor, la definición de los efectos económicos de la contratación irregular y la implantación de mecanismos efectivos de responsabilidad personal.El trabajo proporciona un marco propositivo orientado a compatibilizar el rigor legal con la funcionalidad administrativa, garantizando la tutela del interés público y los derechos de los operadores económicos.

This thesis offers a legal analysis of irregular public procurement in the Spanish public sector, with particular focus on the local level. It highlights practices that breach the principles of transparency, competition, and legality, such as verbal agreements, unauthorized contract extensions, and lack of planning. It explores the various mechanisms available in the legal framework for the regularization of such irregularities: ex officio review, extrajudicial credit recognition, contractual and non-contractual liability, the principle of unjust enrichment, omission of budgetary oversight, and the legal fiction of the “non-existent contract”. The research reveals a widespread and often abusive use of these mechanisms, which, rather than serving as exceptional tools, have become normalized practices. This reality undermines legal certainty and hampers the accountability of public officials. The thesis proposes de lege ferenda reforms, including the creation of a unified procedure for regularization, simplification of minor procurement, clear criteria for determining the economic consequences of irregular procurement, and effective instruments for imposing personal liability.This work provides a constructive framework for reconciling legal rigor with administrative functionality in public procurement, safeguarding the public interest while ensuring the protection of economic operators' rights.

Aquesta tesi analitza jurídicament la contractació irregular en el sector públic espanyol, amb especial incidència en l’àmbit local, tot posant èmfasi en les pràctiques contràries als principis de publicitat, concurrència i legalitat, com ara l’encàrrec verbal, la pròrroga de contractes sense cobertura legal o la manca de planificació.Es descriuen les diferents vies que l’ordenament jurídic ofereix per a la regularització d’aquestes situacions: revisió d’ofici, reconeixement extrajudicial de crèdit, responsabilitat patrimonial i contractual, principi d’enriquiment injust, omissió de la funció fiscalitzadora i la figura del contracte inexistent. La investigació constata l’ús generalitzat i sovint abusiu d’aquests mecanismes, que han deixat de ser excepcionals per convertir-se en pràctiques habituals, amb el consegüent impacte negatiu en la seguretat jurídica i la responsabilitat dels gestors públics. Es proposa una reforma de lege ferenda que inclogui la creació d’un procediment únic de regularització, la simplificació de la contractació menor, la delimitació clara dels efectes econòmics de la contractació irregular i la incorporació de mecanismes efectius per exigir responsabilitats.La tesi ofereix un marc propositiu per garantir l’equilibri entre legalitat i funcionalitat en la contractació pública, tot assegurant la tutela de l’interès públic i dels drets dels operadors econòmics.
