Abstract

El creciente número de controversias tributarias bajo el mecanismo de arbitraje de inversiones pone de relieve la necesidad de un análisis exhaustivo del tratamiento de las cuestiones tributarias en los Acuerdos Internacionales de Inversión (AII). La presente investigación profundiza sobre la vinculación entre el Derecho internacional de las inversiones y el Derecho tributario, con especial énfasis en los mecanismos de resolución de conflictos. Puntualmente, se revisa el impacto de los casos recientes y se identifican patrones en el tratamiento de los asuntos tributarios por parte de los tribunales arbitrales en materia de inversión. La tesis adopta un enfoque crítico el cual revela que el referido mecanismo no es adecuado para lidiar con asuntos tributarios.

The growing number of tax disputes in investment arbitration emphasizes the importance of conducting an in-depth analysis of the treatment of tax issues in International Investment Agreements (IIAs). This research explores the link between Investment Law and Tax Law, with special emphasis on dispute resolution mechanisms. It reviews the impact of recent cases and identifies patterns in the treatment of tax matters by arbitral panels in investment arbitration. The thesis adopts a critical approach which reveals that investment arbitration is not adequate to deal with tax matters.
