La calificación del concurso de acreedores: aspectos procesales

Abstract

La calificación del concurso de acreedores ha sido estudiada desde múltiples perspectivas, y a través de numerosas obras y estudios. Ello no obstante, la mayoría de dichos estudios se han centrado en una perspectiva material, dejando a un lado, o abordando de forma secundaria, los aspectos procesales. Existen sin embargo diversos aspectos procesales que han generado, y siguen generando, grandes dudas interpretativas, tanto entre la doctrina, como en la práctica forense cotidiana. Entre dichos problemas, cabe destacar, por su importancia práctica, los relativos a la naturaleza procesal del informe de calificación de la administración concursal, el cómputo del plazo de presentación del Informe de calificación de la administración concursal, la prematura sección de calificación concursal, la posición de los acreedores y personas con interés legítimo en la sección de calificación, las limitaciones del juicio verbal en la tramitación del incidente de calificación culpable del concurso, los requerimientos documentales realizados a través del informe de calificación de la administración concursal, las interacciones de la cosa juzgada y la calificación culpable del concurso, las interacciones de las acciones de reintegración en la sección sexta, el concurso de leyes entre causas de culpabilidad del concurso y el delito concursal.

La qualificació del concurs de creditors ha estat estudiada des de múltiples perspectives, i a través de nombroses obres i estudis. Això no obstant, la majoria d'aquests estudis s'han centrat en una perspectiva material, deixant de banda, o abordant de forma secundària, els aspectes processals. Existeixen, però, diversos aspectes processals que han generat i, que segueixen generant, grans dubtes interpretatius, tant entre la doctrina, com en la pràctica forense quotidiana. Entre aquests problemes, cal destacar, per la seva importància pràctica, els relatius a la naturalesa processal de l'informe de qualificació de l'administració concursal, el còmput del termini de presentació de l'Informe de qualificació de l'administració concursal, la secció prematura de qualificació concursal, la posició dels creditors i persones amb interès legítim en la secció de qualificació, les limitacions del judici verbal en la tramitació de l'incident de qualificació culpable del concurs, els requeriments documentals realitzats a través de l'informe de qualificació de l'administració concursal, les interaccions de la cosa jutjada i la qualificació culpable del concurs, les interaccions de les accions de reintegració a la secció sisena, el concurs de lleis entre causes de culpabilitat del concurs i el delicte concursal.

The qualification of bankruptcy proceedings has been studied from multiple perspectives, and through numerous works and studies. However, most of these studies have focused on a material perspective, leaving aside, or addressing secondarily, the procedural aspects. There are various procedural points that have generated, and continue to generate, great interpretive doubts, both in the doctrine and in daily forensic practice. Among these problems, it is worth highlighting, due to their practical importance, those relative to the procedural nature of the bankruptcy administration's qualification report, the calculation of the deadline for submitting the bankruptcy administration's qualification report, the premature bankruptcy qualification section, the position of the creditors and persons with a legitimate interest in the qualification section, the limitations of the oral judgment in the processing of the guilty qualification incident of the insolvency, the documentary requirements made through the qualification report of the bankruptcy administration, the interactions of the res iudicata and the guilty qualification of the contest, the interactions of the reintegration actions in the sixth section, the contest of laws between causes of guilt of the contest and the bankruptcy crime.
