Abstract

Aquesta tesi doctoral consisteix en una anàlisi del costum com a font de normes, així com de les implicacions que això té quan afirmem que el costum és una font del dret i que, per tant, entre les normes que componen el dret d'una societat es troben normes jurídiques consuetudinàries. A aquest efecte, el primer capítol indaga sobre les condicions conceptuals del que anomenem «normes consuetudinàries». El capítol segon examina la manera com les normes consuetudinàries poden ser adoptades o reconegudes per un sistema jurídic per passar a ser pròpiament «normes jurídiques consuetudinàries». El capítol tercer indaga el paper que tenen les normes consuetudinàries com a base dels sistemes jurídics. El capítol quart aprofundeix sobre els fonaments filosòfics (conceptuals) que permeten dir que el dret és un producte convencional i que, com a tal, necessàriament recorre requereix normes consuetudinàries (convencionals) per existir. El capítol cinquè aborda els elements que tradicionalment la doctrina ha considerat necessaris per identificar les normes jurídiques consuetudinàries, i procura donar una explicació d'aquests elements que sigui analíticament consistent. Finalment, ja que se sol dir que el costum és la primordial font del dret internacional públic, el capítol sisè busca traslladar els resultats obtinguts dels capítols anteriors per proporcionar una explicació a alguns dels principals dilemes que enfronta la dogmàtica del dret internacional.

This doctoral thesis consists of an analysis of custom as a source of norms, as well as the implications that this has when we affirm that custom is a source of law and that, therefore, among the norms that make up the law of a society are customary legal norms. To this aim, the first chapter explores the conceptual conditions of what we call «customary rules». The second chapter examines the way in which customary norms can be adopted or recognized by a legal system to become properly «customary legal norms». The third chapter investigates the role of customary norms as the basis of legal systems. The fourth chapter delves into the philosophical (conceptual) foundations that allow us to say that the law is a conventional product and that, as such, it necessarily recurs and requires customary (conventional) norms to exist. The fifth chapter tackles the elements that the doctrine has traditionally considered necessary to identify customary legal norms and seeks to provide an explanation of these elements that is analytically consistent. Finally, since it is often said that custom is the primary source of public international law, the sixth chapter seeks to transfer the results obtained from the previous chapters to provide an explanation to some of the main dilemmas faced by the dogmatics of international law.
