Equivalentes funcionales de la pena retributiva: comportamiento postdelictivo y significado comunicativo del hecho punible

Abstract

Based on the distinction between a criminal offence (conceived as a historical event) and a punishable fact (dynamic concept), in my doctoral thesis I present a theoretical frame for the identification, classification and analysis of certain behaviours carried out after the violation of a primary norm. To do so, I use two basic tools. Firstly, I defend a concrete version of a retributive-communicative justification of punishment, which is framed in a conception of the (criminal) law as an agent-collectively constructed praxis. Secondly, I turn to the sociological field in order to incorporate the comparative method of functionalism of equivalences. Once these theoretical and methodological tools have been refined, the central outlines of the model are grounded. From this point, I identified and classified the potential functional equivalents of retributive punishment. Finally, three concrete institutes have been selected to test the model's performance capacity.

Con base en la distinción entre injusto culpable (suceso histórico) y hecho punible (concepto dinámico), el trabajo propone un modelo teórico para la identificación, clasificación y análisis de determinados comportamientos posteriores al quebrantamiento culpable de la norma. Para ello, se sirve de dos herramientas básicas. En primer lugar, se adopta una teoría retributivo-comunicativa de las acciones punitivas, enmarcada en una concepción del Derecho (penal) como praxis agencial colectivamente construida. En segundo lugar, se recurre al campo sociológico y se adopta el método comparativo del funcionalismo de las equivalencias. Una vez depuradas estas herramientas teóricas y metodológicas, se establecen los lineamientos centrales del modelo. A partir de allí, se identifican y clasifican los potenciales equivalentes funcionales de la pena retributiva. Finalmente, se seleccionan tres institutos concretos para poner a prueba la capacidad de rendimiento del modelo.
