Abstract

El propósito de la presente tesis consiste en analizar las generalidades de la interacción entre diversos actores que intervienen en la ordenación de las relaciones laborales en el ámbito internacional, dentro del marco conceptual de trabajo decente, y tomando como base las actividades de la OIT. En concreto, el análisis se circunscribe al dominio de la seguridad y salud en el trabajo, como consecuencia de la existencia de conflictos entre normas que se reputan pertenecientes al ámbito del derecho internacional público (los convenios y recomendaciones adoptados por la Organización sobre seguridad y salud en el trabajo), y otras, de reciente adopción, consideradas normas híbridas. A través del análisis conceptual y dogmático de los elementos relevantes, el objeto de la disertación se dirige a identificar escenarios o ámbitos problemáticos, así como a proveer elementos útiles a la conceptualización del derecho a la seguridad y salud en el trabajo como un componente del trabajo decente, dentro del marco del derecho internacional del trabajo.

The purpose of this thesis consists in analyzing the general features of the interaction between different actors which take part in the international labour regulation in the frame of decent work, and taking ILO related activities as reference. The analysis is confined to the health and safety at work scope as a consequence of recent conflicts between norms belonging to international public law, and others considered hybrids. By means of a conceptual and legal analysis of the relevant elements, the dissertation object is addressed at identifying problematic scenarios, and providing for useful elements in order to conceptualize the right of health and safety at work as a component of decent work in the frame of International Labour Law.
