Abstract

Esta tesis doctoral versa sobre la flexibilidad del procedimiento civil. El objetivo general es realizar una reconstrucción teórica de esta noción en materia procesal civil. Nuestra pretensión es identificar los diferentes aspectos de la flexibilidad procedimental, reunirlos y elaborar con ellos una explicación teórica coherente y con suficiente potencia explicativa. Con este objetivo, elaboramos un concepto funcional de flexibilidad según el cual esta puede ser entendida como adaptabilidad. En segundo lugar, desarrollamos los fundamentos de la flexibilidad: la instrumentalidad del Derecho procesal y la eficiencia de la justicia. A propósito de estos fundamentos, nos referimos a los fines u objetivos de la justicia civil. A continuación, elaboramos un concepto estructural de flexibilidad para luego analizar en detalle los diversos mecanismos e instituciones que confieren flexibilidad al procedimiento. Por último, analizamos y comparamos, a través del prisma de la flexibilidad, los criterios que determinan el procedimiento aplicable en España, Chile e Inglaterra.

This PhD thesis deals with the flexibility of civil procedure. The general objective is to carry out a theoretical reconstruction of this notion in the context of civil procedure. Our aim is to identify the different aspects of procedural flexibility, bring them together and elaborate a coherent theoretical explanation with sufficient explanatory power. With this objective, we elaborate a functional concept of flexibility according to which it can be understood as adaptability. We then develop the fundaments of flexibility: the instrumentality of procedural law and the efficiency of justice. With regard to these foundations, we refer to the aims or goals of civil justice. Next, we elaborate a structural concept of flexibility to then analyze in details the various mechanisms and institutions that provide flexibility to the procedure. Finally, we analyze and compare, through the prism of flexibility, the criteria that determine the applicable procedure in Spain, Chile and England.
