La reforma procesal penal federal en México

Abstract

En México, la procuración e impartición de justicia se encuentra en crisis según diversos diagnósticos científicos sobre el estado que guarda la justicia penal. La superación del estado actual de las cosas se presenta necesaria. La tesis doctoral, la reforma procesal penal en México, aborda el vigente modelo de enjuiciamiento criminal, y su posible transformación, con base en la Constitución de 1917, el Código Federal de Procedimientos Penales de 1934 y los principios procesales reconocidos. El estudio se realiza comparativamente con los modelos español, alemán y norteamericano, que son jurídicamente más avanzados, con el propósito de obtener mayores opciones de respuesta ante la necesidad de superar el sistema inquisitivo vigente y adoptar un sistema acusatorio. La tesis se conforma de cuatro partes generales: una primera, en la que se presenta el marco legal constitucional del Estado de derecho mexicano, crisol del concepto de jurisdicción, sentando las bases de su organización jurídica y de la estructura organizativa del Poder Judicial en México, su gobierno y acceso a la carrera judicial; una segunda, en la que se hace referencia a los principios procesales y lineamientos jurídicos consagrados, que deben ser combinados con el principio acusatorio a fin de configurar un modelo nuevo de enjuiciamiento criminal; una tercera, que presenta los desaciertos y los grandes problemas que impiden considerar al sistema mexicano como un verdadero proceso penal, garante de los derechos y principios jurídicos consagrados por la Constitución y por los Tratados internacionales signados por México; y una cuarta parte, motivo fundamental de todas las demás que sirven de preparación, que se forma con una nueva propuesta de concepción del enjuiciamiento criminal en México para adoptar de forma definitiva un proceso acusatorio con juicio oral y público.
