Abstract

El objeto de la presente tesis doctoral versa sobre el estudio de homicidios y asesinatos perpetrados por sujetos afectos de trastornos mentales catalogados por los manuales diagnósticos CIE-10 (OMS) y DSM-IV (APA). El estudio se ha dividido en dos partes claramente diferenciadas; en primer lugar se ha procedido al estudio teórico de las figuras tipificadas en el Código Penal español de 1995 en los artículos 138 y 139, así como las circunstancias modificativas de la responsabilidad criminal que tienen efectos atenuatorios o que eximen al sujeto de la pena privativa de libertad que se contemplan en el Código penal, para los supuestos en concreto, imponiéndose bien una medida de seguridad, bien una pena privativa de libertad con una medida de seguridad, siguiendo el sistema vicaria! instituido en nuestro Derecho. En segundo lugar se ha realizado un estudio en el que se ha procedido a la extracción de la Jurisprudencia de las Audiencias Provinciales de dos puntos de la península ibérica situados en el norte y sur de la misma, que poseen características concomitantes, cuales son densidad poblacional y elementos geográficos convergentes (fachada atlántica, localidades de zona rural interior montañosa) en concreto se escogieron las CCAA de Asturias y Galicia en el norte de España y las provincias de Cádiz, Huelva y Sevilla en el sur. Se extrajeron los datos relativos al sexo, edad, arma, psicopatología, sentencia, fases lunares, pena privativa de libertad o medida de seguridad entre otros sometiéndolos a diferentes análisis estadísticos, a fin de comprobar las diferencias o concomitancias entre ambos extremos geográficos y diferentes variables. El presente estudio, ha resultado de la interdisciplinariedad de forma mayoritaria entre Psicopatologias (ora mayores ora caracteropatias) y delitos de homicidio y asesinato.
