La usurpación pacífica de inmuebles

Abstract

En el presente trabajo de investigación, se realiza el análisis jurídico de la denominada “usurpación pacífica de inmuebles”. Para llevar a cabo un estudio global de la cuestión, se realiza un examen tanto sustantivo como procesal de la misma, en la medida en que la comprensión total de la materia objeto de investigación impide escindir ambas facetas del derecho penal. El estudio se estructura en dos partes. En la primera, se aborda la descripción del delito descrito en el art. 245.2 CP, llegándose a la conclusión, a partir del bien jurídico, que quedan fuera del tipo los arrendamientos de inmuebles, los supuestos de precario, los usos esporádicos y las ocupaciones de inmuebles abandonados. A continuación, se refieren las eximentes que podrían ser de aplicación en relación a ciertos supuestos típicos de ocupación de inmuebles y se constata que el estado de necesidad es el que ofrece mayores posibilidades. En la segunda parte, se expone cuáles son los mecanismos de autotutela y de heterotutela de la posesión civil, con especial consideración del proceso penal, quedando de manifiesto la indebida instrumentalización de tal mecanismo al servicio del desalojo de los ocupantes.

This investigation is intended as a legal analysis of the so-called “peaceful usurpation of property”. To conduct a comprehensive analysis of the issue, it was considered necessary to perform a substantive and procedural review of it, as a full comprehension of the matter under investigation excludes the possibility of separating these two aspects of criminal law. The investigation is divided into two parts. Firstly, we address the description from criminal offense in article 245.2 CP, which leads to the conclusion from the legal interest protected, that rents, tolerated occupations, sporadic uses and abandoned properties are excluded of the criminal offense. Following this we review the possible circumstances for exemptions which could be used in relation to certain abstract cases of occupation of properties and it is found that the most alleged and applied between them is the necessity. Secondly, we present the mechanisms of civil possession protection, with special attention to the criminal process, which shows the undue use of such a mechanism for occupants eviction.
