La ambientalización del derecho internacional humanitario

Abstract

This thesis, entitled The greening of International humanitarian law, aims to analyze the protection it receives the environment in times of armed conflict under the international legal system. Given the existing constraints, the proposed the greening of International humanitarian law, understood as the incorporation of norms, principles, standards and/or mechanisms of the International environmental law in the rules of International humanitarian law. The main idea of this research is that Public international law has evolved into an essentially community structure, transforming the international legal order in a complex regulatory system in which the different international regimes have to integrate and relate coherently and harmoniously. It is the responsibility of the different legal operators to promote and ensure the harmonization principle that should prevail in contemporary Public international law using all the tools and techniques available in this regulatory system.
