Acercamiento al proceso concursal de insolvencia transfronteriza

Abstract

En el mundo actual hay una necesidad de enfrentarse a un reto: los negocios ya traspasan las fronteras y en los mismos termina habiendo de por medio un conflicto de ordenamientos jurídicos. De cara a dicha situación, la comunidad internacional ha encontrado que es necesario tomar medidas para la protección de los derechos del acreedor trasnacional frente a un deudor que se enfrenta a la insolvencia. En Colombia se le pretende dar una solución a dicho problema por medio de la Ley 1116 de 2006, en la cual el legislador patrio acogió el proyecto presentado por la Comisión de las Naciones Unidas para el Derecho Mercantil Internacional, en adelante: CNUDMI, el cual en el presente trabajo ha de ser caracterizado y criticado.
