El principio de culpabilidad como límite a la intervención penal

Abstract

En la doctrina jurídico penal no existe un uso unívoco de la expresión “principio de culpabilidad”, por lo que en este trabajo se busca indagar por el sentido de esta garantía -- Para lograrlo, se explica cómo la evolución de la categoría dogmática de la culpabilidad desde la teoría psicológica a las teorías normativas ha propiciado dicha ambigüedad y se propone una clasificación convencional para introducir una mayor claridad -- A continuación, se estudia el debate entre las concepciones utilitarias de la culpabilidad y las tradicionales teorías del merecimiento de pena, pasando antes por la discusión en torno al libre albedrío -- Dicha exposición busca establecer en qué medida tales criterios satisfacen o no las exigencias que las normas constitucionales y legales imponen a la culpabilidad -- Por último, desde el criterio de justicia que ofrece la fórmula de la exigibilidad, se lleva a cabo una explicación de los diversos elementos de la categoría de la culpabilidad y se estudia la posibilidad de admitir supuestos supralegales de no exigibilidad de otra conducta
