Estabilidad laboral reforzada por salud en Colombia : abusos y repercusiones para las empresas

Abstract

La estabilidad laboral reforzada por razones de salud es una protección que garantiza, a los trabajadores afectados por condiciones de salud, un marco legal que impide que sean despedidos de manera arbitraria o injustificada. El objetivo de este trabajo es caracterizar los abusos y las repercusiones que ha generado, y aún hoy genera, esa prerrogativa de los trabajadores en las empresas colombianas. Como método, se realizó una investigación cualitativa con enfoque jurídico y empresarial, de corte transversal, mediante el análisis de normativas, jurisprudencia y casos en empresas del país. Se encontró que la estabilidad laboral reforzada por salud ha cumplido su propósito de proteger a los trabajadores en condiciones de vulnerabilidad; sin embargo, su aplicación ha generado dificultades para los empleadores, incluyendo costos adicionales, litigios prolongados y restricciones en la gestión del talento humano. Sobre los abusos en la utilización de esta figura, se evidenció que algunas personas aprovechan estrategias para mantenerse en sus cargos sin cumplir con los requerimientos organizacionales, lo cual ha generado un impacto negativo en la productividad. En cuanto a las repercusiones para las empresas, se identificó que estas enfrentan desafíos administrativos y financieros debido a la imposibilidad de terminar contratos sin autorización judicial, lo cual limita su capacidad de reestructuración y planificación laboral. Por último, en relación con los mecanismos de prevención y solución, se identificó que el cumplimiento riguroso de la normatividad, junto con estrategias de gestión de salud ocupacional y talento humano, pueden mitigar los efectos adversos de esta figura. Como conclusión, se evidenció que la estabilidad laboral reforzada es una herramienta de protección necesaria, pero requiere un equilibrio entre la seguridad del trabajador y la sostenibilidad empresarial, con el fin de evitar abusos que perjudiquen la dinámica organizacional. Reinforced labor stability for health reasons is a protection that guarantees workers affected by health conditions a legal framework that prevents them from being dismissed in an arbitrary or unjustified manner. The objective of this work is to characterize the abuses and repercussions that this prerogative of workers in Colombian companies has generated and still generates today. As a method, qualitative research with a legal and business approach was carried out, with a cross-sectional approach, through the analysis of regulations, judicial precedent and cases in companies in the country. The results indicate that reinforced job stability has fulfilled its purpose by protecting workers in vulnerable conditions. Nevertheless, its application has created challenges for employers, including additional costs, prolonged litigation, and restrictions on talent management. Regarding the misuse of this legal protection, evidence suggests that some employees have used strategies to remain in their positions without fulfilling organizational requirements, negatively impacting productivity. As for the repercussions on companies, businesses face administrative and financial difficulties due to their inability to terminate contracts without judicial authorization, limiting their capacity for restructuring and workforce planning. Finally, in relation to prevention and resolution mechanisms, strict compliance with regulations, along with occupational health and talent management strategies, can mitigate the adverse effects of this figure. In conclusion, reinforced job stability is a necessary protective measure but requires a balance between worker security and business sustainability, preventing abuses that may harm organizational dynamics.
