Apartheid de género : viabilidad jurídica de su codificación como crimen de lesa humanidad en el marco del derecho internacional contemporáneo

Abstract

Este análisis jurídico explora la viabilidad de incluir el género como un elemento constitutivo del crimen de lesa humanidad de apartheid en el marco del derecho penal internacional. Se analiza el concepto de apartheid de género como un sistema de discriminación estructural y violencia institucionalizada contra las mujeres y otras identidades de género, comparándolo con los regímenes de apartheid racial y persecución de género, definidos en el Estatuto de Roma. Mediante un enfoque interdisciplinario que incluye la jurisprudencia internacional, las convenciones sobre derechos humanos, las perspectivas críticas de género, y el análisis de casos de estudio, se examinan los elementos jurídicos necesarios para clasificarlo como crimen de lesa humanidad. Asimismo, se aborda el potencial impacto de dicha clasificación en la promoción de la igualdad de género, la erradicación de prácticas opresoras, y el acceso a mecanismos de justicia y medidas de reparación para las víctimas y sobrevivientes de la opresión por motivos de género a nivel global.

This legal analysis explores the feasibility of including gender as a constituent element of the crime against humanity of apartheid under international criminal law. It analyzes the concept of gender apartheid as a system of structural discrimination and institutionalized violence against women and other gender identities, comparing it to the racial apartheid and gender persecution regimes, defined in the Rome Statute. Through an interdisciplinary approach that includes international jurisprudence, human rights conventions, critical gender perspectives, and case study analysis, it examines the legal elements necessary to classify it as a crime against humanity. It also addresses the potential impact of such classification on the promotion of gender equality, the eradication of oppressive practices, and access to justice mechanisms and reparations for victims and survivors of gender-based oppression globally.
