Abstract

La evolución de los animales domésticos alrededor de los años ha permitido que estos puedan llegar a ser considerados como parte de la familia, puesto que actualmente preocupa más la forma en que el ser se relacione con los otros miembros del núcleo y su entorno y esto, junto con otras razones, han hecho que en las decisiones de algunos jueces se pasara a considerar un nuevo tipo de familia, como es la multiespecie. Sobre esto, si bien la normativa civil colombiana establece que los animales son un bien mueble y seres sintientes, hoy en día la legislación ha venido cambiando al otorgarles el carácter de seres sintientes junto con una especial protección para una vida digna, como ocurre con la Ley 1774 de 2016 . Sin embargo, y debido a la nueva concepción de la familia multiespecie, todavía quedan vacíos normativos frente a lo relativo a la separación o ruptura de esta. En ese sentido, el presente trabajo de grado, mediante el método de investigación cualitativa, se centró en analizar y estudiar si, a partir de los diferentes conceptos que han acogido los jueces nacionales sobre la familia multiespecie y las diferentes normas relativas al cuidado y bienestar de los animales, es posible equiparar el régimen de alimentos, visitas y custodia del Código Civil colombiano y sus normas complementarias sobre estos seres que forman parte de la familia, puesto que quedan dudas frente a ¿cómo se asigna la tenencia y los cuidados de estos seres?, ¿se encuentra una solución a este problema a través del derecho de propiedad o mediante el derecho de familia?

The evolution of domestic animals over the years has allowed them to be considered as part of the family, since nowadays the way in which the animal relates to the other members of the family and its environment is of greater concern, and this, together with other reasons, has led some judges to consider a new type of family, such as the multi-species family. On this, although Colombian civil law establishes that animals are movable property and sentient beings, today the legislation has been changing by granting them the character of sentient beings along with special protection for a dignified life, as is the case with Law 1774 of 2016 . However, and due to the new conception of the multispecies family, there are still regulatory gaps regarding the separation or rupture of this. In this sense, this degree work, through the qualitative research method, focused on analyzing and studying whether, based on the different concepts that national judges have adopted on the multispecies family and the different rules relating to the care and welfare of animals, it is possible to equate the regime of food, visits and custody of the Colombian Civil Code and its complementary rules on these beings that are part of the family, since doubts remain regarding how the custody and care of these beings is assigned, Is a solution to this problem found through property law or through family law?
