Los trabajadores en misión y la estabilidad laboral reforzada del fuero de salud

Abstract

El presente trabajo apunta a realizar un análisis doctrinal, jurisprudencial y legal acerca de cómo opera el fuero de salud en los trabajadores en misión y cómo, producto de la debilidad manifiesta en su salud, se origina la estabilidad laboral reforzada, teniendo en cuenta las diferentes posturas que se tiene en la jurisprudencia desarrollada por las altas Cortes. Además, se analizará la problemática que se presenta para las Empresas de Servicios Temporales cuando el requerimiento del servicio temporal finaliza y la estabilidad laboral reforzada con la que cuenta el trabajador en misión impide su desvinculación.

This paper aims to perform a doctrinal, jurisprudential and legal analysis on how health protection operates in contract workers and as a result of weakness as manifested, gives way to reenforced labor stability, keeping in mind the different postures present in the jurisprudence of the high Colombian Courts. It will question how it does affect Temporary Service Companies because of the timeframe that the contract worker is allowed to be working at the user company.
