Abstract

Para determinar la causalidad, la doctrina y la Corte han optado por diversas teorías. Sin embargo, ante la concurrencia de causas en desarrollo de actividades peligrosas (accidentes de tránsito, en particular) por hecho o culpa de la víctima, el tratamiento jurisprudencial ha sido escaso. Esta investigación identifica las sentencias más relevantes proferidas entre 2019 y 2022 por la Corte Suprema de Justicia, en las que la Sala Civil se enfrentó a dichos supuestos, con el propósito de identificar las soluciones y criterios empleados. También, mediante la presente monografía se toma postura frente a la posición jurisprudencial más reciente y se plantea una propuesta en la aplicación de criterios que permitan facilitar la determinación del nexo causal.

To determine causation, the doctrine and the Court have opted for various theories. However, in the face of the concurrence of causes in the development of dangerous activities (traffic accidents, in particular) due to the fact or fault of the victim, the jurisprudential treatment has been scarce. This research identifies the most relevant judgments handed down between 2019 and 2022 by the Supreme Court of Justice, in which the Civil Chamber faced such assumptions, with the purpose of identifying the solutions and criteria used. Also, this monograph takes a position on the most recent jurisprudential position and proposes the application of criteria to facilitate the determination of the causal link.
