La investigación que se desarrolla en la siguiente tesis de monografía presenta la figura jurídica de la ineficacia de traslado en los regímenes pensionales, para ello se realiza un balance del cumplimiento en el deber de información por parte de las administradoras de fondos de pensiones. Así mismo, se exponen los alcances de la omisión del deber de información a los afiliados en el sistema general de pensiones y se determina la relevancia de la exigencia de la doble asesoría. Teniendo como objetivo el conocimiento de los beneficios y/o afectaciones que la declaratoria de la ineficacia de traslado genera a las personas cotizantes que buscan retornar al régimen pensional inicial.

The research that is developed in the following monograph thesis is presents the legal figure of the ineffectiveness of transfer in pension regimes, for this a balance is made of compliance with the duty of information on the part of the pension fund administrators. Likewise the scope of the omission of the duty information to the affiliates in the general pension system is exposed and the relevance of the requirement of double counseling is determined. Having as objective the knowledge of the benefits and/or affectations that the declaration of the ineffectiveness of the transfer generates to the contributors who seek to return to the initial pension scheme.
