Abstract

Con el desarrollo de la tecnología, las redes sociales virtuales se han convertido en una de las principales fuentes de acceso a la información y a los datos personales de los usuarios que hacen uso de ellas. Situación que ha generado un sin fin de conflictos; este fenómeno aumenta cada día más, y con ello proporcionalmente el uso irresponsable de estos medios de comunicación masivos. Por lo que, además de afectar el ámbito social y personal de los usuarios, también se empezó a ver afectada su situación jurídica. Esta investigación tiene como objetivo determinar el alcance que tiene el derecho fundamental constitucional a la intimidad bajo la lógica propia de las redes sociales virtuales, analizándolo desde la posibilidad de usar fotos captadas de estas, como pruebas en procesos judiciales civiles; y mucho más, en el entendido de que las fotografías que los usuarios postean en una de las redes sociales más importantes, como lo es Facebook, se pueden incorporar a un proceso judicial civil como prueba, situación que puede generar, un quebrantamiento de las libertades esenciales de una persona, como lo es el derecho a la intimidad.

The development of technology has achieved that social networks become in one of the main sources to access to information and personal data of its users, this is a situation that has generated endless conflicts; this phenomenon increases every day and with this the irresponsible use of these mass media too. So besides to affect the social and personal scope of its users, the legal status of them. This research aims to determinate the scope of the Fundamental Constitutional Right to privacy under the logic of social networks, analyzing it from the possibility of using photos from social networks in civil judicial processes as evidence, and much more in the understanding that the documents that the users post on one of the most important social networks such as Facebook is, can be incorporated into a civil judicial process as evidence; this situation could be a violation of the essential liberties of a person, such as the right to privacy.
