El derecho a la intimidad como límite al derecho a la prueba en el marco de las nuevas tecnologías

Abstract

Mediante este proyecto de investigación se pretende determinar la relación entre el derecho a la intimidad y el derecho a la prueba en el marco de las nuevas tecnologías. Para ello, será necesario en un primer momento contextualizar el derecho a la intimidad y su protección en el ordenamiento jurídico, así como la regulación del derecho a la prueba, sus características, y sus límites. Esto desde el enfoque de las nuevas tecnologías que han irrumpido en la sociedad actual mediante internet, redes sociales, aplicaciones, bases de datos, entre otros, las cuales si bien suponen nuevas posibilidades probatorias, también conllevan un mayor riesgo de vulneración del derecho a la intimidad. En un segundo momento, se analizará la intromisión de las nuevas tecnologías en el proceso civil y en el proceso penal, determinando como estas pueden incorporarse legítimamente en los procesos judiciales. Además, teniendo en cuenta el riesgo potencial que estas nuevas tecnologías frente al derecho a la intimidad, también será necesario estudiar la disponibilidad de este derecho, así como los límites y mecanismos de protección establecidos en el ordenamiento jurídico colombiano, abordando temas de especial interés como las facultades de investigación de la fiscalía, el derecho a la intimidad de las personas privadas de la libertad, y la prueba ilícita. Para esta investigación, se consultará la normativa, jurisprudencia, y doctrina colombiana, además de doctrina internacional relevante.

This research project aims to determine the relationship between the right to privacy and the right to evidence in the framework of new technologies. For this, it will be necessary at first to contextualize the right to privacy and its protection in the legal system, as well as the regulation of the right to evidence, its characteristics, and its limits. This from the perspective of the new technologies that have broken into today's society through the internet, social networks, applications, databases, among others, which, although they represent new evidential possibilities, also carry a greater risk of violation of the right to privacy. In a second stage, the interference of new technologies in civil and criminal proceedings will be analyzed, determining how these can be legitimately incorporated into judicial processes. In addition, taking into account the potential risk that these new technologies imply against the right to privacy, it will also be necessary to study the availability of this right, as well as the limits and protection mechanisms established in the Colombian legal system, addressing issues of special concern. special interest such as the investigative powers of the prosecution, the right to privacy of persons deprived of liberty, and unlawful evidence. For this research, Colombian regulations, jurisprudence, and doctrine will be consulted, as well as relevant international doctrine.
