La SIC ha encontrado que el objetivo de creación de un cartel empresarial es eliminar la competencia entre los participantes del mercado, conllevando a una baja variedad, calidad de los bienes o servicios e incremento de los precios, generando así un perjuicio a los consumidores y demás actores del mercado. Estos también pueden entenderse como acuerdos anticompetitivos que también han sido definidos como aquellos contratos, convenios o prácticas que son concertadas entre dos o más empresas, y que tienden a restringir la competencia. (Decreto 2153, 1992, art 45) La SIC, a raíz de la presencia constante de estos escenarios del mercado, ha basado sus decisiones en elementos que le permiten identificar cuándo se está en presencia de un cartel empresarial.
