Abstract

La ignorancia deliberada es entendida como la actitud asumida por el autor de una conducta dolosa, que, a pesar de tener la posibilidad de adquirir el conocimiento de los elementos mínimos objetivos del tipo, no lo hace, por lo que se le imputa responsabilidad dolosa sin que concurra el elemento conocimiento, pues este es reemplazado por la figura de la ignorancia deliberada. Dicha figura tomó especial importancia en el ordenamiento jurídico español desde el año 2000 cuando el Tribunal Supremo comenzó a utilizarla en sus decisiones, acogiendo la figura del willful blindness proveniente del derecho angloamericano. La ignorancia deliberada es incompatible con el ordenamiento jurídico colombiano, dado que, el concepto legal del dolo exige el elemento conocimiento, el que no puede ser reemplazado, so pena de violentar el principio de legalidad y prohibición de analogía in malam partem.

Deliberate ignorance is understood as the attitude assumed by the author of a malicious conduct, which, despite having the possibility of acquiring knowledge of the minimum objective elements of the type, it does not, for which it is imputed fraudulent liability without the element of knowledge, as this is replaced by the figure of deliberate ignorance. This figure took on special importance in the Spanish legal system since the year 2000 when the Supreme Court began to use it in its decisions, embracing the figure of willful blindness from Anglo-American law. Deliberate ignorance is incompatible with the Colombian legal system, since, the legal concept of fraud requires the element of knowledge, which can´t be replaced, under penalty of violating the principle of legality and prohibition of analogy in malam partem.
