Factores de fracaso en la aplicación del proceso de reorganización empresarial ley 1116 de 2006

Abstract

En la primera parte del presente trabajo se condensa, de forma precisa, en qué consiste la ley 1116 de 2006 o insolvencia en Colombia y las repercusiones que tiene en las empresas que se acogen a ella. Posteriormente, se caracterizan las tendencias de las compañías que ven la necesidad de una reorganización y se caracteriza, de manera general, el panorama colombiano. El éxito detectado en el porcentaje de compañías que sacan el mayor provecho de la ley 1116 de 2006 está estrechamente relacionado a la estructura financiera y a su flujo de caja, a la capacitación de los dirigentes en cuanto a conocimientos financieros, a su gobierno corporativo y a las características competitivas que tiene la compañía. Estos factores son revisados en detalle.

This paper collects in a accurate way what is Act 1116 (2006) or bankruptcy Law in Colombia and the repercussions that this Act has over the companies that appeal to this. Secondly, the paper shows the trends of de companies that use this act to take advantage and stay on the market and some Colombian statistics. The success of the companies after a reorganization is closely related to financial structure, financial skills of leaders, corporate governance and competitive skills of the company. These factors were detailed reviewed.
