Acuerdos de La Habana : ¿un acuerdo de Estado?

Abstract

El Acuerdo Final para la Terminación del Conflicto y la Construcción de una Paz Estable y Duradera, firmado el 26 de septiembre de 2016 en Cartagena, expresión de las negociaciones entre el Estado colombiano y las Fuerzas Armadas Revolucionarias de Colombia-Ejército del Pueblo (FARC-EP), constituye un proceso histórico de gran relevancia nacional e internacional. El resultado del plebiscito, mecanismo elegido por el Gobierno para aprobar o denegar los Acuerdos de la Habana, fue adverso. Sin embargo, el proceso jurídico y político continuó. Opositores al acuerdo expresaron en diversos escenarios que este no era legítimo, mientras miembros del Gobierno, negociadores y actores de la comunidad nacional e internacional hicieron esfuerzos para cumplir lo pactado. Este texto plantea como tesis principal que los Acuerdos de la Habana son un asunto de Estado y no sólo un asunto de gobierno, fijando el foco sobre el punto 2 del documento final y, en especial, a lo referente a la participación política y de las herramientas que permiten ampliarla significativamente.

The Final Agreement for the Termination of the Conflict and the Construction of a Stable and Lasting Peace, signed on September 26, 2016 in Cartagena, expression of the negotiations between the Colombian State and the Revolutionary Armed Forces of Colombia-People's Army (FARC- EP), constitutes a historical process of great national and international relevance. The result of the plebiscite, a mechanism chosen by the Government to approve or deny the Havana Accords, was adverse. However, the legal and political process continued. Opponents to the agreement expressed in various scenarios that this was not legitimate, while members of the Government, negotiators and actors of the national and international community made efforts to comply with the agreement. This text proposes as a main thesis that the Havana Agreements are a matter of State and not just a matter of government, setting the focus on item 2 of the final document and, in particular, regarding political participation and tools that allow expanding it significantly.
