Abstract

La consulta previa es un derecho fundamental que busca proteger a las comunidades culturalmente diferenciadas cuando se ven afectadas por obras que se realizarán en sus territorios o por decisiones de entidades públicas (legislativas o administrativas) -- En Colombia este derecho es reconocido como fundamental exclusivamente a comunidades étnicas; pese a esto, la corte ha venido aceptando ampliando la aplicación del mismo al menos de forma tímida, para garantizar el acceso a la participación de comunidades no consideradas étnicas, por encontrarse en situaciones de vulnerabilidad ante proyectos de alto impacto ambiental y que, por lo tanto, necesitan especial protección por parte del Estado -- Por ello, se pretende mostrar la realidad de estas comunidades y la necesidad que tienen que tener mecanismos de participación efectivos que tengan una real incidencia en las decisiones que los afectan como comunidad

The prior consultation is a fundamental right that seeks to protect culturally differentiated communities when they are affected by works that are carried out in their territories or by decisions of public entities (legislative or administrative) -- Colombia recognized this right only to ethnic communities, however, the Constitutional Court has been accepted (at least slightly) this right to non-ethnic communities, such as peasant communities, since in this country they are a vulnerable part of the population that needs special protection by the State -- Therefore, it is intended to show the reality of these people and the transgression of the constitutional rights that have been presented to this community, throughout the history of Colombia, in addition, it is proposed an analysis of the recognition and enforceability of the fundamental right to the prior consultation for the peasants
