O Direito de Trabalho foi e sempre será, uma área do Direito muito peculiar e contestada, visto que, cada dia que passa está em constante mudança e alteração. Cada vez mais, se assiste a uma sociedade vinculada por normas e regras que regulam de forma coersiva. Um desses exemplos é o chamado Contrato de Trabalho, cujas regras vinculam o trabalhador à entidade patronal (e vice versa), mas de forma a que ambos cumpram determinados direitos e deveres préviamente estabelecidos. Para responder às diversas situações, criaram-se algumas modalidades de contratos de trabalho, afim de poderem “ajustar” as necessidades de cada parte. Desta forma, surgem novas modalidades de contratos para responderem às necessidades das empresas, como é o caso do Contrato de Trabalho Intermitente. Os Direitos Fundamentais foram consagrados na Constituição, eles já existiam e são inerentes ao próprio ser humano. Temos de ter em conta que o trabalhador antes de o ser, também é uma pessoa, e como pessoa, já tem direitos que lhe são subjacentes e nascem com ele, como é o caso do Direito à vida. Increasingly, there is a society bound by rules and regulations governing so coercive.
