Abstract

Yorum konusu genel hukuk teorisinin ve hukuk metodolojisinin temel konula rından biri olmaya devam etmektedir. Alman hukukunda yorum konusunda temel tartışmalar özünde anayasa hukuku ve demokrasi teorisini ilgilendiren bir nitelik taşımaktadır. Yorum konusu güçler ayrılığı ve hukuk devleti bağlamında tartışılmaktadır. Hukukta yorum denince Almanya´da ve tüm dünyada akla hala Savigny gelmektedir. Savigny zamanının hukuk biliminin metodolojiik tartışma larını özetlemiş ve yorumun dört unsurunu öne çıkarmıştır. Savigny bu unsur ları gramatik, mantıki, tarihsel ve sistematik unsurlar olarak adlandırmaktadır. Savigny hukukta hermeneutiğin öncülerinden biri olarak görülmektedir. Hukukta hermeneutik yöntemin uygulanmasıyla yasa metninin her bir hukuk uygulamacısı için her zaman, her koşulda aynı anlamı veren bir nesne olmadığını tespit ederiz. Farklı uygulamacılar için aynı metin farklı anlam ifade eder.

The juridical interpretation is still continuing one of the main topics of the general theory of law and juridical methodology. The debates in the German law focus mainly on the constitution law and the theory of democracy. The topic of the inter- pretation is discussed in relation to the checks and balances and the rule of law. If we mention the interpretation in Germany and in the whole world, we remember still Savingy. Savigny summarized the methodological debates in his time and he pointed out the four elements of the interpretations. Savigny called these elements as grammatical, logical, historical and systematical elements. Savigny is regarded also as a pioneer of the hermeneutic in the jurisprudence.
