Evolución histórica del derecho colectivo de trabajo en Costa Rica : Historia de acciones y reacciones en la construcción del discurso jurídico

Abstract

El presente artículo tiene como objeto dar un marco conceptual e histórico a partir del cual poder interpretar los alcances y limitaciones de las relaciones laborales en Costa Rica en la actualidad, para lo cual plantea la existencia de tres etapas de desarrollo de las relaciones laborales y los instrumentos relacionados con el derecho laboral colectivo, seguidas todas por reacciones conservadoras que impiden o limitan el ejercicio de la libertad sindical, la negociación colectiva, la resolución de conflictos colectivos y la huelga. Estas reacciones conservadoras utilizan diversos mecanismos de disciplinamiento y control sindical y laboral, incluyendo la creación de un canal no sindical de representación colectiva que es controlado y dirigido por el sector empleador y que es contradictorio y compite con el canal sindical de representación.
