El derecho a la salud en la jurisprudencia de la Sala Constitucional de Costa Rica

Abstract

El presente estudio analiza la protección que ha recibido el derecho a la salud, el cual no se encuentra expresamente previsto en el texto vigente de la Constitución Política de Costa Rica de 1949, por ello su reconocimiento se ha dado vía jurisprudencial, a través de un gran activismo por parte de la Sala Constitucional de Costa Rica, motivo por el cual la doctrina lo considera como un nuevo derecho. En particular, se analizarán los principales criterios jurisprudenciales constitucionales que han sido desarrollados en esta temática.
