La utilización de jurisprudencia constitucional extranjera por la Sala Constitucional

Abstract

El presente estudio pretende analizar el impacto del derecho comparado en la jurisprudencia de la Sala Constitucional de la Corte Suprema de Justicia de Costa Rica. En particular, se tomará en cuenta únicamente el formante jurisprudencial a fin de evidenciar con que frecuencia y en que temáticas los jueces constitucionales recurren al método comparado, en particular a resoluciones de órganos de justicia constitucional. Para ello se analizaran una serie de sentencias en las que expresamente se citan resoluciones de la Corte Suprema de los Estados Unidos de América, el Tribunal Federal Constitucional Alemán, la Corte Constitucional Italia, el Tribunal Constitucional Español, el Consejo Constitucional Francés y la Corte Constitucional Colombiana con la finalidad de determinar cuál ha sido el peso que se le ha concedido al argumento comparado, en particular si ha tenido o no incidencia en el proceso decisional al que se llegó. Por otra parte, se estudiará si la jurisprudencia de la Sala Constitucional ha tenido alguna influencia o ha sido utilizada por otros Tribunales Constitucionales, a fin de determinar la existencia de un diálogo judicial en el ámbito de la tutela jurisdiccional de los derechos fundamentales.
