El acceso a internet como derecho fundamental

Abstract

La protección de derechos fundamentales no es una competencia exclusiva de cada Estado, diversos organismos internacionales, como la Organización de Naciones Unidas, se han encargado de establecer declaraciones, convenios y tratados para garantizar dichos derechos. Se habla entonces de una tutela multinivel de los derechos fundamentales. Asimismo, diversos factores como la globalización, avances científicos y tecnológicos o la internacionalización de derechos humanos han dado lugar al surgimiento de nuevos derechos, entre ellos el acceso a Internet como derecho fundamental. Este artículo analiza la Internet como un derecho social que debe ser satisfecho con prestaciones públicas; para fundamentar esta posición se utiliza normativa de instrumentos internacionales así como referencias jurisprudenciales. Además, se determinan las deficiencias que existen en cuanto al acceso a Internet en Costa Rica y se hace un llamado a la búsqueda de soluciones para que toda la población tenga un efectivo y mayor alcance a esta Red.
