Abstract

Con la presente contribución, pretendo llamar la atención sobre algunas de las particularidades procesales del Derecho Penal Juvenil a la luz de la jurisprudencia de la Corte Interamericana de Derechos Humanos. No se trata de un análisis completo de todas las garantías y principios del derecho procesal de adultos en comparación con el derecho procesal penal de menores. Se intenta más bien, de destacar las particularidades que en el mismo sentido ha señalado la Corte Interamericana de Derechos Humanos al respecto. Por su naturaleza y extensión, dicho análisis pretende ser una guía y no un texto de consulta a nivel procesal penal. Por otra parte, la escasez de pronunciamientos de parte de esta Corte específicamente sobre este tema, tampoco lo permite.

With this contribution, I pretend to catch atention about some procedural particularities, regarding the juvenile criminal law in the context of the jurisprudence of the Inter-American Court of Human Rights. This is not a complete analysis of all guarantees and procedural principles adult´s compared with juvenile criminal procedural law. It is intended to highlight the particularities of the procedure according with the pronouncements of the American Court of Human Rights in this regard. By its nature and extent, this analysis is a guide, not a reference text at criminal proceedings. Moreover, is the shortage of pronouncements from this Court specifically on this issue, that not permitting it.
