El desistimiento voluntario: causa de atipicidad en Costa Rica

Abstract

El desistimiento voluntario debe ser abordado, en Costa Rica, como causa de atipicidad, pues la regulación legal no lo contempla. Igual sucede en otros países latinoamericanos. Aunque la doctrina lo puede tratar como causa de exculpación o, en otros casos, como una condición objetiva de punibilidad, debe estarse a la regulación de cada país, sin importar, acríticamente, soluciones. En Costa Rica si hay desistimiento voluntario no hay tentativa y si no hay tentativa no hay tipo penal porque la norma no regula el tema; por lo tanto, tampoco puede haber sanción. Así, si el autor desiste de la comisión de delito, los partícipes, por la teoría de la accesoriedad limitada, serán excluidos de sanción por más que estos hayan tenido toda la intención de continuar con la actividad delictiva. Asimismo, dado que la responsabilidad penal es personal, el coautor que desista tendría una conducta atípica; de igual forma al coautor que no desplegó actos ejecutivos, el desistimiento del primero también ha de serle atribuido.
