Empréstitos Públicos: ¿Tratados internacionales o contratos administrativos?

Abstract

El crédito público es un instrumento que tiene el Estado para endeudarse para poder financiar y desarrollar proyectos que ayuden al crecimiento del país, la principal herramienta que se utiliza para estos efectos es el Empréstito Público, que es un contrato de préstamo para los Estados, y que se encuentra regulado por nuestra Constitución Política en los artículos 121 inciso 15 y 140 inciso. En la doctrina se discute cual es la naturaleza jurídica de los Empréstitos, y por lo tanto, existen varias teorías con respecto al tema, para una parte de la doctrina se tratan de Tratados Internacionales, ya que los acreedores de estos prestamos por lo general son sujetos con personería internacional, creados por el derecho internacional público, y cuyo capital es también extranjero y gozaría de una protección internacional.
