Abstract

El trabajo pretende contestar la siguiente pregunta fundamental: ¿son consistentes las bases históricas y teóricas utilizadas por la Sala Constitucional en materia de derechos colectivos del empleo público? Para hacerlo se hace un análisis histórico del derecho del trabajo en Costa Rica y el proceso que culmina con la Constitución Política de 1949, así como un análisis histórico y teórico de la denominada "teoría estatutaria del empleo público" y su evolución en los procesos de transición democrática
