La Reforma Procesal Laboral de Costa Rica

Abstract

El presente artículo tiene como objetivo comentar y analizar la reforma procesal que ha impulsado el Poder Judicial, al Código de Trabajo de Costa Rica, vigente desde su promulgación mediante Ley No. 2 del 26 de agosto de 1943.- El proyecto de reforma fue remitido por el Poder Ejecutivo a la Asamblea Legislativa y publicado en el Diario Oficial La Gaceta el día 30 de setiembre del dos mil cinco, y se encuentra actualmente en conocimiento de la Comisión de Asuntos Sociales. Este proyecto pretende introducir el principio de Oralidad a los procesos laborales, con el objetivo de agilizar la duración de este tipo de procesos. Además la reforma pretende modificar temas relacionados con el derecho colectivo del trabajo, como la regulación de la huelga, y se regula la solución arbitrada y negociada de los conflictos colectivos económicos del trabajo. No obstante lo anterior, el proyecto no viene a solucionar el problema de la efectividad o materialidad de la sentencia, tema en el cual el suscrito hace una serie de recomendaciones. Finalmente pretende instaurar el Recurso de Casación en materia laboral, cuando lo más práctico y beneficioso para la tutela del trabajador es dejar este aspecto como está regulado actualmente como una tercera instancia rogada.
