Justicia restaurativa y garantías en la justicia penal juvenil

Abstract

El artículo estudia la idea de la justicia restaurativa, como un concepto que enfatiza el papel de la autor y la víctima en la resolución del conflicto. Esta justicia tiene sus orígenes en la forma de resolución de conflictos de los grupos indígenas. El reconocimiento de la justicia restaurativa en el derecho penal en general (de adultos y menores) obedece al principio educativo que ha implementado ideas de este tipo de justicia en Derecho Penal Juvenil. En el artículo se hace referencia a los buenos resultados de los proyectos de justicia restaurativa y la relación de esta figura con otros derechos constitucionales, pero advierte del peligro de que su implementación configure una extensión del control social punitivo, sino atiende al principio de proporcionalidad.
