Abstract

El autor analiza, a partir de un caso presentado en la jurisprudencia costarricense, las posiciones asumidas en cuanto a si debe aceptarse que el acuerdo conciliatorio declarado nulo en un proceso penal juvenil posee efectos interruptores sobre la prescripción de la acción penal, aplicando supletoriamente normativa de adultos. Se toma partido por rechazar dicha posibilidad atendiendo a la especialidad de la materia.

The author analyzes a case decided in the jurisprudence of Costa Rica. Exponed positions taken regarding whether to accept the settlement declared invalid in juvenile criminal proceedings has effects in the interruption of law prescription of prosecution, applying supplementary rules of adults. It chooses to reject this possibility considering the specialty of the matter.
