El complemento retributivo de continuidad asistencial en el Servicio Andaluz de Salud: ¿Es un derecho absoluto?

Abstract

Este artículo trata de desentrañar, desde la interpretación de su regulación normativa, si el ‘complemento retributivo de continuidad asistencial’ se trata de un derecho absoluto o automático para ciertos profesionales o, por el contrario, es modulable o disponible por los órganos directivos de los Centros Asistenciales del Servicio Andaluz de Salud en base a su potestad de organización, y ampliable a todos los facultativos de un determinado Servicio o Unidad. Se concluye que no se trata de un derecho absoluto o automático que se deba abonar a determinados profesionales y que el mismo es modulable o disponible por los órganos directivos.
