Abstract

Analizar los elementos utilizados para determinar la culpa patronal según el criterio de la Corte Suprema de Justicia Sala de Casación Laboral. El presente proyecto pretende el análisis de los elementos usados por la Sala de Casación Laboral de la Corte Suprema de Justicia para la determinación de la culpa patronal y la imposición de sanciones. De acuerdo con las sentencias analizadas, para que se determine la culpa patronal, el trabajador debe demostrar la omisión por parte del empleador en el cumplimiento de las obligaciones a su cargo, probando el nexo causal entre tal omisión y el daño sufrido. El empleador en aras de probar lo contrario, debe demostrar que obró con diligencia, previsión, cuidado razonable, responsabilidad y oportunidad en el cumplimiento de sus deberes y obligaciones para con el trabajador, sin que se le endilgue una carga excesiva que supere sus posibilidades. This project aims to analyze the elements used by the Labor Cassation Chamber of the Supreme Court of Justice for the determination of the employer's fault and the imposition of sanctions. According to the judgments analyzed, for the employer's fault to be determined, the worker must demonstrate the omission on the part of the employer in complying with the obligations under his charge, proving the causal link between such omission and the damage suffered. The employer, in order to prove the contrary, must prove that he acted with diligence, foresight, reasonable care, responsibility and opportunity in the fulfillment of his duties and obligations towards the worker, without placing an excessive burden on him that exceeds his possibilities.
