La prueba toma un papel fundamental en el Derecho ya que esclarece los hechos y determina la responsabilidad de las partes, más aun, en materia penal la prueba tiene un rol central dado que permite al juez salir de la duda razonable y por ende fijar la culpabilidad o inocencia de las personas; cabe aclarar que son varios los medios mediante los cuales pueden practicarse estas pruebas uno de ellos es el Peritaje, un Medio Probatorio de notables características objetivas, dentro de las cuales se encuentra la experticia con la que se realiza y sobre todo la asertividad de su contenido. Ahora bien, en los procesos de Acceso Carnal Violento con Menor de 14 años (en adelante ACV14) donde se ve inmiscuida una población vulnerable, analizando si el Operador de Justicia puede basarse solamente en los dictámenes periciales sexológicos para establecer la responsabilidad de los acusados y poder proteger a las víctimas de estos delitos o debe analizar todos los medios puestos a su conocimiento y dotarlos de determinado valor con el mismo fin, siguiendo la normatividad penal (art 380-381) que establece los criterios de valoración y la motivación para logara rue el juez profiera una sentencia legitima y acorde a derecho para resolver estos interrogantes la presente investigación se desarrollara bajo los siguientes ejes temáticos, primero i) expone unos conceptos preliminares sobre la prueba, segundo ii) se examinará el dictamen pericial y su aplicación en el ACV14 y iii) por último, se hará el mismo estudio sobre los demás medios probatorios que se puedan practicar en este proceso, para poder determinar importancia del peritaje en el proceso de ACV14 en comparación con los demás medios probatorios que se puedan practicar. The test takes a central role in the law as it clarifies the facts and determine the responsibility of the parties, moreover, in criminal matters the test has a central role since it allows the judge to leave a reasonable doubt and therefore fix the guilt or innocence of individuals; it is clear that there are several means by which you can practice these tests one of them is the Expertise, a Middle Probation notable objective characteristics, among which we find the expertise with which it is performed and especially the assertiveness of its contents. Now in the process of violent sexual intercourse with a child under 14 years (hereinafter ACV14) where a vulnerable population is intruded, we consider whether the operator of Justice may be based only on the expert opinions sexological to establish the liability of the defendants and to protect the victims of these crimes or to analyze all the means at their knowledge and provide them with certain value for the same purpose, to answer these questions this research will be developed under the following themes, first i) presents some preliminary concepts about the test, second ii) analyze the expert opinion and its application in the ACV14 and iii) Finally, do the same study on other evidence that can be practiced in this process to conclude whether the expert should have greater importance on the rest of the evidence used in the process ACV14.
