Abstract

Mientras que la prescripción de la acción y de la sanción se erige como una expresión de la autolimitación del Estado en materia penal, tratándose de crímenes de lesa humanidad, la imprescriptibilidad opera como una excepción. En opinión de la autora, el fundamento para ello obedece al carácter de gravedad tanto del delito como del bien jurídico protegido; es decir, de vocación, contenido e interés universales, toda vez que su perpetración vulnera un interés común y supremo de la Humanidad (ius cogens). Este trabajo se interesa en particular al proceso normativo (convencional y consuetudinario) así como a su integración en el orden interno, no siempre de forma coherente o suficientemente argumentada por los operadores judiciales. Whereas the prescription of action and sanction is an expression of the self-limitation of the State in penal matters, the non-applicability of statutory limitations for crimes against humanity plays as an exception. In the author’s opinion, the reason for must to be found in the gravity of the offense; it is to say, that the crime itself, as well as the protected juridical good have a vocation, content and interest of a universal dimension, to the extent of its perpetration harms a common and supreme interest of the Humanity (ius cogens). This work is especially focused in the normative process (conventional and customary) as well as its integration in the internal order, not always in a coherent way or sufficiently argued by the judicial operators.
