El contenido de este artículo de reflexión nos muestra a lo largo de la historia de la importancia que puede tener dentro del sistema jurídico colombiano, la incorporación del daño a la salud como perjuicio inmaterial, este daño se aborda con los casos históricos que rodearon a sus antecesores y con la necesaria referencia del principio de reparación integral, e igualdad para los administrados, lo anterior con el fin de responder al interrogante de como el Estado colombiano dentro de su responsabilidad y bajo un mecanismo adecuado podría reparar e indemnizar en materia de perjuicios inmateriales.
