El presente artículo tiene por objeto analizar el desarrollo legal colombiano en materia de protección de datos personales a lo largo de los últimos 10 años, lo cual conllevara a determinar si los mecanismos establecidos para su garantía son suficientes e idóneos para que la Superintendencia de Industria y Comercio (SIC) pueda de manera eficaz y efectiva salvaguardar los derechos fundamentales que podrían verse afectados en su tratamiento indebido. De esta manera, concluiremos, que si bien el panorama legal colombiano comienza a dar pasos firmes en cuanto a estructurar un marco legal solido en esta materia, el éxito de un real amparo a estos derechos fundamentales dependerá principalmente de las medidas preventivas y no correctivas que estratégica y metodológicamente implemente la SIC. The present article has for object analyze the legal Colombian development un terms of protection of personal information throughout last 10 years, which will carry to determine if the mechanisms established for its guarantee are sufficient and suitable in order that the Superintendence of Industry and Trade (SIT) could in an effective and effective way safeguard the fundamental rights that might turn affected in its undue treatment. In this way, we will conclude, that though the legal Colombian panorama begins to give firm steps as for structuring a legal solid frame in this matter, the success of a real protection to these fundamental rights will depend principally on the preventive measures and not corrective that strategic and methodologically the SIT implements.
