La industria aeronáutica cada vez es más propensa a generar más debates sobre la falta de estandarización y claridad de regulaciones internacionales en diversos temas dando paso a problemáticas que afectan negativamente al sector, un ejemplo de lo anterior se puede apreciar en el aumento de reclamos y quejas jurídicas en el incumpliendo del contrato de transporte por causa de la denegación de embarque producto del overbooking o sobreventa de tiquetes aéreos, cancelaciones de vuelos y grandes retrasos en el transporte aéreo por parte de los usuarios. El Departamento de Transporte de Estados Unidos ha reportado que entre enero y septiembre de 2015 se presentaron 428.925 pasajeros afectados por la denegación de embarque producto de la sobreventa de tiquetes1, así mismo en el comunicado de prensa No. 86 elaborado por la Aeronáutica Civil en Colombia presento que entre junio y julio de 2015 el monto total de las indemnizaciones a los pasajeros por sobreventa, cancelaciones y retrasos fue de $8´434.069.756 de pesos2. Un factor generador de lo anterior es la falta de una normativa internacional que regule, controle y estandarice prácticas como el overbooking y su compensación a los afectados. Estados como Colombia, EE.UU, Chile, Brasil, México y la comunidad europea han emitido una serie de recomendaciones y regulado por medio de sanciones pecuniarias algunas de estas prácticas cuyo objetivo es proteger los derechos de los pasajeros, sin embargo no es suficiente y en algunos casos la indemnización no es proporcional al daño causado. En este orden de ideas la presente investigación tendrá como objetivo analizar los problemas generados por la práctica del “overbooking” por parte de las aerolíneas y realizar una comparación critica de la normativa Colombiana que regula esta actividad con respecto a otros países con el fin de analizar si realmente son eficaces y velan por proteger los derechos de los pasajeros y/o hacer cumplir los deberes de las organizaciones que prestan el servicio de transporte aéreo. The aircraft industry is increasingly likely to generate more discussion about the lack of international standardization and clarity of regulations in various areas leading to problems which adversely affect the sector, an example of the above can be seen in the increase in legal claims and complaints on the breach of contract transportation because of denied boarding overbooking product of air tickets, flight cancellations and long delays in air transport the users. A generator of the above factor is the lack of an international standard to regulate, control and standardize practices such as overbooking and compensation to those affected. States and Colombia, USA, Chile, Brazil, Mexico and the European Union have issued a series of recommendations and regulated by means of financial penalties some of these practices which aims to protect the rights of passengers, but it is not enough and in some cases compensation is not proportional to the damage caused. In this order of ideas this research will aim to analyze the problems generated by the practice of "overbooking 'by airlines and make a critical comparison Colombian regulations governing this activity with respect to other countries in order to if they really are effective and ensure protection of the rights of passengers and / or enforce the duties of organizations providing air transport service.
