Partiendo del concepto y la historia de la flagrancia, y haciendo mención a varios pronunciamientos que ha hecho la doctrina y la jurisprudencia sobre el tema, se hará un análisis de la situación fáctica y jurídica del desarrollo que ha tenido la flagrancia en tres áreas que son típicas manifestaciones del Derecho Sancionatorio, comenzando por el Derecho Penal como el referente más completo en su significado y aplicación, para luego aterrizar en el Derecho Ambiental el cual implemento la figura a partir del año 2009, finalizando con el Derecho Disciplinario Régimen General Ley 734 de 2002 y el Especial de las Fuerzas Militares Ley 836 de 2003, concluyendo con una comparación de los principales aspectos de la flagrancia en estas ramas del Derecho, que tan cotidianos son los casos de flagrancia en estos ámbitos y que tan útil es para el Derecho Ambiental y para el Derecho Disciplinario que se mantenga esta figura conforme al propósito de cada procedimiento Starting from the concept and flagrancy history, and with the reference to various statements the doctrine and jurisprudence on the subject has made, it will make an analysis of the factual and legal situation of the development that has taken In three areas that are typical manifestation of the punitive law, beginning by criminal law as the most complete reference in its meaning and application, before landing in environmental law which implement the figure form 2009, and finally the disciplinary Law 734 of 2002 and special Military Law 836 of 2003, concluding with a comparasion of key aspects of flagrancy in these areas of Law, how everyday are cases of flagrante delicto in these areas and how useful it is for environmental law and disciplinary law that this figure in maintained acoording to the purpose of each procedure
