Abstract

La contratación de obras públicas es una práctica fundamental para el desarrollo del país. A lo largo de los años se han presentado constantes modificaciones con el fin que el proceso de contratación sea eficaz y transparente. A pesar de las modificaciones y adiciones normativas se siguen presentando vacíos y deficiencias en el control por parte de las entidades estatales en el proceso de la contratación pública de obras civiles. El objetivo de este artículo es analizar la normatividad para la contratación de obras públicas en Colombia a través del tiempo desde la promulgación de la Ley 80 de 1993 hasta el decreto 1510 de 2013 y sus implicaciones contractuales para el contratante y el contratista. Para dar cumplimiento a dicho objetivo, se realizaron encuestas a empresas relacionadas con obras civiles, lo que permitió analizar los efectos de las reformas normativas. Encontrando que los factores más importantes que influyen en la modificación de la normatividad, son los actos de corrupción que a lo largo de los años han marcado la contratación pública y la implementación de tecnología en beneficio del Estado.

The hiring of public works is a fundamental practice to the country's development. Over the years there have been constant changes in order that hiring process is effective and transparent. Despite regulatory changes and additions are still shortcomings and deficiencies in the monitoring by state agencies in the process of hiring of public works. The aim of this article is to analyze the normativity for the hiring of public works in Colombia over time since the enactment of Law 80 of 1993 until the Decree 1510 of 2013 and their contractual implications for the contractor and the hired part. To fulfill this objective, were performed polls to public works related companies, which allowed analyzing the effects of normativity's reforms. Finding that the most important factors influencing the modification of the normativity are acts of corruption that over the years have marked the public hiring and implementation of technology for the benefit of the state.
