Abstract

El presente artículo realiza un análisis del sistema de responsabilidad penal para adolescentes (Ley 1098 de 2006), con el objeto de establecer si la legislación vigente responde con efectividad y eficacia a las trasgresiones a la ley penal cometidas por adolescentes. Se examina si es necesario realizar una reforma al sistema de justicia actual para lograr una mejor respuesta del Estado frente a las características personales del menor infractor. Para el desarrollo de éste análisis socio-jurídico se acudirá a los parámetros del método deductivo, por lo que se abordará en primer lugar los convenios y tratados internacionales sobre justicia para adolescentes y a partir de ellos revisar el tratamiento que en la legislación colombiana ha tenido el tema antes de haber sido expedida la ley 1098 de 2006 que es el actual código de la infancia y la adolescencia, para finalmente determinar qué aspectos del procedimiento aplicable.deben ser modificados, atendiendo la realidad social de los adolescentes en conflicto con la ley penal colombiana. Así las cosas, este estudio concluye que es necesario valorar la situación del adolescente trasgresor en el Estado colombiano de manera individual, para determinar la gravedad del daño causado y el tratamiento que requiere. This article analyzes the system of criminal responsibility for adolescents - Law 1098 of 2006, in order to establish whether the current legislation effectively and efficiently respond to transgressions committed by teenagers. It examines whether it is necessary to reform the current justice system to ensure better response of the State to the personal characteristics of juvenile offenders. For the development of this socio-legal analysis will attend the parameters of the deductive method, which will be addressed primarily to the international conventions and treaties on justice for adolescents and from them to review the treatment that Colombian legislation has had the issue before it was issued the Law 1098 of 2006 which is the current code of childhood and adolescence to finally determine what aspects of the procedure should be modified, following the social reality adolescents in conflict with the Colombian criminal law. So, this study concludes that it is necessary to assess the situation of the transgressor adolescents in the Colombian State individually, to determine the severity of the damage and the judicial treatment required.
