De conformidad con los lineamientos señalados en el artículo 90 de la Carta Política, al Estado le asiste la responsabilidad de asumir los costos que se generen por los daños antijurídicos causados por sus agentes, en consecuencia, se han establecido en el ordenamiento jurídico las acciones contencioso administrativas como los mecanismos idóneos para que las personas puedan acudir ante las autoridades a fin de solicitar el restablecimiento de sus derechos o en su defecto el resarcimiento económico de los perjuicios causados; no obstante a lo anterior, existen otros mecanismos como la Conciliación Extrajudicial, la cual es una herramienta útil que permite a las partes involucradas en el conflicto realizar un proceso de negociación y obtener un acuerdo. En consecuencia, resulta indispensable diseñar un modelo de defensa prejudicial estatal frente a fallas en la prestación del servicio médico, dado el elevado número de solicitudes de conciliación promovidas contra entidades estatales encargadas de la prestación de este servicio, en el cual se realice un análisis sustancial y procesal que permita identificar la existencia de los elementos que configuran el daño antijurídico y por consiguiente la responsabilidad del estado, para luego hacer una propuesta seria que logre la solución del conflicto, permitiendo direccionar en la misma forma los criterios a tener en cuenta por los profesionales del derecho que defienden los intereses de la nación, evitando así el traslado de las pretensiones a los despachos judiciales, donde después de agotar una serie de etapas y términos supremamente largos, terminan condenando a la Nación en sumas exorbitantes que afectan el erario público.
